Understanding the Georgia Breath TestThe current breath-testing machine used by the state of Georgia is the Intoxilyzer 5000. This is simply a device police officers use to detect whether or not a person has been drinking over the current legal limit of 0.08. The officer has the suspect breathe into a tube, which then produces a reading. While this may sound like a threatening, super sophisticated device, it has some design flaws. These weaknesses are our strength when defending DUI charges. Diabetes, esophageal hernia, heartburn, liver disease, or other illnesses can all cause inaccurate readings on this device. Even gum or cough syrup can cause false readings. And police officers are not necessarily properly trained to use this device. Many times they are given only minimal training. We'll find out whether or not the officer used the device correctly. So don't be afraid of this device. We will determine whether or not this machine was inaccurately used. |
